I skimmed the patents.  NeoMedia does have a legitimate patent.  Thus, the EFF group is simply trying to kill the patent.  I wonder what they feel about other patents - such as the telephone.  It would be a terror to our society to take away the patents that individuals and companies create as part of an on going business.  Investments are made based on patents.
